1.         INTRODUCTION

1.1      You will be able to access most areas of this website without registering your details with us. Certain areas of this website are only open to you if you register.

1.2      We may revise these terms and conditions at any time by updating this posting. You should check this website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this website.

 

2.         ORDERING FROM US

 

2.1      You are deemed to place an order with us by ordering via our online checkout process. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement, detailing the products you have ordered.

2.2      Our acceptance of an order takes place when we despatch the order. We will send you a despatch confirmation by email. When we despatch the order the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.

2.3      We may refuse to accept an order:

(a)       Where goods are not available;

(b)       Where we cannot obtain authorisation for your payment;

(c)       If there has been a pricing or product description error; or

(d)       If you do not meet any eligibility criteria set out in our terms and conditions.

 

3.         PRICE AND PAYMENT

 

3.1 The prices on the Website are in POUNDS STERLING and are inclusive of VAT and any other applicable taxes (which are charged at the current rate at the time of purchase). We will do what we reasonably can to ensure that the prices stated on the Website are accurate and up to date. In the event of any pricing errors, we will notify you by email or telephone and give you the opportunity to re-confirm your Order at the correct price.

3.2 You must pay for the Goods at the time of submitting your Order. As stated at section 2.1 above, by placing your Order you will be under an obligation to pay for the Goods at that time. Payments must be made by credit or debit card or PayPal (please see the relevant part of the Website for a list of those payment cards accepted and method of payment). By submitting a credit or debit card number, you: (a) confirm that your use of the particular card is authorised and that all information that you submit is true and accurate; and (b) authorise us to charge to the card all amounts payable by you to us (including VAT and any other applicable taxes) in connection with your Order. If, for whatever reason, we do not accept your Order, we will refund your payment in full.

3.3 You may be subject to validation checks and/or third-party authorisations depending on your method of payment.

3.4  Please note that, even if the contract has been concluded, we do not have to provide the Goods to you at the incorrect price if the pricing error is obvious and could reasonably have been recognised as a pricing error. 

3.5 The following terms will apply if you have selected the Interest Free Credit payment option: -

  • 3.5.1  The Interest Free Credit facility is provided by V12 Retail Finance Limited (“V12 Retail Finance”), which is authorised and regulated by the Financial Conduct Authority;
  • 3.5.2  To be eligible to apply for Interest Free Credit, you must be over the age of 18, work at least 16 hours a week in a permanent job, or be retired with an income. You must also be a resident of the United Kingdom and have lived in the UK for the last 3 years or more.
  • 3.5.3  Interest Free Credit is available on jewellery and giftware purchases over £500. The Goods must be delivered to your billing address, so please ensure this is selected in the ‘Delivery Details’ section of Checkout.
  • 3.5.4  If you wish to pay for your Goods by way of Interest Free Credit, you should select ‘Pay in monthly instalments with 0% Interest FREE Credit’ from the list of payment methods which are displayed on the Checkout screen. You will be presented with a finance calculator which you can use to select your preferred payment terms and deposit amount.
  • 3.5.5  If you wish to proceed, you will then be re-directed to V12 Retail Finance website to complete your credit application. You should note that the credit application is subject to V12 Retail Finance terms and conditions, and it will be assessed and processed by V12 Retail Finance;
  • 3.5.6 Once you have completed the credit application, you will be taken back to the G Cornell & Sons Ltd website;
  • 3.5.7 As soon as we receive confirmation from V12 Retail Finance that your agreement has been finalised, we will process your Order. If we accept your Order, we will send you the Despatch Email.
  • 3.5.8  You should note that we will not allocate the Goods to your Order until V12 Retail Finance have confirmed to us that your credit agreement has been finalised. If the Goods are not available at that time, we will contact you to let you know. If we are unable to accept your Order, V12 Retail Finance will refund the deposit that you have paid. 3.6  Where we charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on this website. 

 

 

4.         CANCELLATION AND RETURNS POLICY

 

4.1      If you wish to cancel your order:

(a)       You can notify us by email to contact@gcornell.co.uk before we have dispatched the goods to you; or

(b)       Where goods have already been dispatched to you, by returning goods to us in accordance with clause 4.2 below.

4.2      You can return goods you have ordered from us for any reason at any time within 14 days of receipt for a full refund or exchange. The costs of returning goods to us shall be borne by you.

4.3     Upon receipt of the goods we will give you a full refund of the amount paid or an exchange credit as required.

4.4      The rights to return the goods to us as referred to in clause 4.2/4.3 will not apply in the following circumstances:

            In the event that the product has been used;

            To any products that we have made or customised specifically for you.

4.5    Under the Consumer Contracts Regulations 2014, a customer is allowed to return an item if they simply change their mind. A customer has the right to cancel at any time from the moment they place their online order, and up to 14 days from the day they receive the goods. The customer then has a further 14 days from the date they notify the retailer of their cancellation to return the goods. -There are exemptions to online returns which include tailor made/personalised goods.

4.6    Under the Consumer Rights Act 2015, a customer has an early right to reject goods that are unsatisfactory quality, unfit for purpose or not as described, and get a full refund. This right is limited to 30 days from the date the customer took ownership of the goods. If an item is faulty and needs to be returned, the customer does not need to pay postage costs for the return of the faulty item. If a customer is asked to return an item that arrived damaged, not as described or faulty, the retailer should refund the total cost of the return.

          

The provisions of this clause 4.4 do not affect your statutory rights.
